Terms of Service

These Terms of Service ("Terms") govern your use of claimcapital (the "Service"). By using the Service, including by claiming a capital city, you agree to these Terms.
1. What the Service is
claimcapital lets you pay to place your startup or project's name, a short pitch, an optional logo, and a link on a pin representing a world capital city on a virtual, 3D globe. Claiming a capital is a novelty display placement only. It does not grant you any real-world ownership of, rights to, or trademark over the city, its name, or anything associated with it, and does not create any partnership, endorsement, or affiliation between you and claimcapital.
2. Pricing and outbidding
Each capital has a price that increases each time it is claimed. Anyone, including the current holder's competitors, may pay the current asking price to take over a capital at any time, which replaces the previous holder's listing entirely. There is no guarantee that your claim will remain in place for any length of time.
3. Payments and refunds
Payments are processed by Stripe. All sales are final — we do not offer refunds for change of mind, dissatisfaction with your placement, or a later claim taking over your capital. The one exception: if you pay for a capital that someone else successfully claims before your payment is confirmed, your payment is automatically refunded in full and your claim does not go through.
4. Your submitted content
Any name, pitch, link, or logo you submit when claiming a capital is displayed publicly on the Service by design, for as long as your claim stands. You're responsible for what you submit, and you confirm you have the rights to any logo or content you upload. We may remove or replace any submitted content that is illegal, infringing, abusive, or otherwise violates these Terms, without notice and without a refund.
5. Prohibited use
You may not use the Service to submit content that is illegal, hateful, obscene, violent, infringes someone else's intellectual property or rights, impersonates another person or organization, or attempts to disrupt, exploit, or gain unauthorized access to the Service.
6. No warranty
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or available at all times.
7. Limitation of liability
To the fullest extent permitted by law, claimcapital and its operator will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the transaction giving rise to the claim.
8. Governing law
These Terms are governed by the laws of Canada, without regard to conflict-of-law principles.
9. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.
